Gay Marriage In Australia

Australia has had a checkered history when it comes to civil rights and equality. From the John Howard government refusal to say sorry to the aboriginal Stolen Generations to the remaining inequities that discriminate against gay Australians, Australia's new Prime Minister Kevin Rudd has a lot to do to make a truly equal Australia for all. Australia's record on gay and lesbian equal rights is not entirely covered in distinction.

From the 1978 gay riots in Sydney's Kings Cross and the resulting gay arrests that precipitated today's annual Sydney Gay and Lesbian Mardi Gras, to the non equal treatment of gays and lesbians before the laws even today in important areas such as superannuation, inheritance, property, the lack of legal access to a sick or dying partner -- Australian gay and lesbian citizens still find themselves treated as second class in the eyes of the law in many areas.

That situation is out of step with the trends in many other parts of the world including Europe. Countries such as the Netherlands and Belgium have equal gay and lesbian marriage rights, and the society in these and other countries where gay couples can marry has not collapsed.

In what was once known as 'the Mother Country' to Australia -- the United Kingdom -- gay and lesbian Civil Partnerships have been occurring in large numbers since 1995, and without major social problems or any diminution of the "institution" of traditional marriage.

Whether Australia eventually opts for gay marriage or civil partnerships or both will be a matter of legal and political developments, but, as Gay Market News reported, the election of a federal Labor Government under Prime Minister Kevin Rudd may augur well for future change to occur.

Under Australia's federal system the Australian Capital Territory (ACT) government seems likely to be the first to act in bringing in Civil Partnerships to allow gay and lesbian territorians to marry.

That will likely see other states follow suit, and Kevin Rudd has stated that such matters are an issue for the states themselves to decide. Previously the former government led by conservative leader John Howard had blocked efforts by the ACT to introduce similar legislation.

It remains good social policy as well as good business to seek policies that see Australian society grounded in fundamental principles of equality and non-discrimination. Equality and respect for all Australians is an ideal worth pursuing.

There remains 58 separate pieces of discriminatory laws against gays and lesbians in Australia and it is to be hoped that the laws against gay marriage, and the many other discriminatory parts of Australian laws, may soon be relegated to history.
